Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Dyafna (“Dyafna”, “we”, “us”). They govern your use of the Dyafna website, guest storefronts and apps (together, the “Platform”). By creating an account, checking in, or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Platform.
1. What Dyafna is
Dyafna is a hospitality platform. We help guests discover and book the establishments on Dyafna — riads, hotels and guesthouses (each, a “Host”) — and the extras they offer: rooms and stays, services, experiences, meals and products. Some items are sold by independent third-party sellers through a Host’s storefront.
Dyafna provides the technology, handles discovery, checkout and payment, and supports both sides. The actual stay, service, experience or product is provided by the Host or seller, not by Dyafna. Your booking for an item is a contract between you and that Host or seller, and they are responsible for delivering it as described.
2. Your account
- You sign in with a one-time code sent to your email, or with Google. Keep access to your email and devices secure — anyone who can receive your code can access your account.
- You must be at least 18 and able to enter into a contract. If you book for other people, you’re responsible for them following these Terms and the Host’s rules.
- Give accurate information and keep it up to date. We may suspend or close accounts that provide false information or are used to abuse the Platform.
3. Bookings and orders
Hosts and sellers set their own descriptions, availability, prices and policies. We show these to you before you pay. When you check out, you make an offer to book the selected items; the booking is confirmed once payment is recorded (or, for cash, once the Host accepts it). Stays are subject to the dates and availability shown at the time of booking.
We act as the Host’s limited agent for collecting payment, which means paying Dyafna satisfies your payment obligation to the Host for that order.
4. Prices, payment and currency
- Prices are shown in Moroccan dirham (MAD). Any taxes and fees that apply, including tourist or city tax, are shown before you confirm.
- You can pay by PayPal or, where a Host allows it, in cash. The available methods are shown at checkout.
- If you pay by PayPal, your card or PayPal balance is charged in euro (EUR) at an exchange rate fixed at the moment of checkout, while your booking itself stays priced in MAD. The euro amount you see at checkout is the amount you pay.
- City or tourist tax collected at check-in is set by local rules (typically per guest, per night) and is separate from the price of any item you order.
5. Cancellations and refunds
Each bookable item shows the Host’s cancellation policy before you pay. Refunds follow that policy and are returned to your original payment method. Where a payment was taken in euro via PayPal, the refund is calculated at the exchange rate fixed for that original payment, so there’s no currency drift.
A Host may also choose to issue a goodwill credit or partial refund at their discretion. To request a cancellation or refund, contact your Host through the Dyafna inbox or email salaam@dyafna.ma. Nothing here limits any non-waivable refund rights you have under the law that applies to you.
6. Check-in, identity and house rules
Moroccan law requires Hosts to register the guests who stay with them. As part of check-in you may be asked to confirm your details, provide a photo of an identity document, and sign. The Host’s house rules are shown to you and recorded as they stood when you signed; by signing you agree to follow them. 7. Acceptable use
You agree not to:
- use the Platform for anything unlawful, fraudulent or harmful;
- provide false identity, payment or check-in information, or impersonate someone else;
- interfere with the Platform’s security, scrape it at scale, or try to access data that isn’t yours;
- mistreat Hosts, staff, other guests or property, or breach a Host’s house rules.
8. For Hosts and sellers
If you use Dyafna to sell stays, services or products, you also agree that you will:
- keep your listings, prices, availability and policies accurate, and honour the bookings guests make;
- hold the licences, registrations and insurance your activity requires, and comply with local law — including guest registration and tourist-tax obligations;
- maintain an active Dyafna subscription where one is required to publish a catalogue, and accept the commission shown for each sale;
- be responsible for your own taxes on the amounts you earn.
Dyafna operates as a single business and collects guest payments centrally. Your earnings, net of commission and any refunds, are paid out to you by Dyafna on a regular basis. Payout details and any separate host agreement you sign apply in addition to these Terms; if there’s a conflict for host-specific matters, that agreement governs.
9. Content and intellectual property
The Dyafna name, logo, software and design belong to Dyafna. When you add content (such as listings, photos, messages or reviews), you keep your rights to it and grant Dyafna a non-exclusive licence to host and display it for the purpose of running the Platform. Don’t post content you don’t have the right to use.
10. Disclaimers
The Platform is provided “as is”. We work hard to keep it accurate and available, but we don’t guarantee it will be uninterrupted or error-free, and listing information comes from Hosts and sellers. The quality, safety and legality of any stay, service, experience or product is the responsibility of the Host or seller who provides it.
11. Limitation of liability
To the fullest extent permitted by law, Dyafna is not liable for the acts or omissions of Hosts, sellers or other guests, or for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud, and your mandatory consumer rights remain unaffected.
12. Suspension and termination
You can stop using Dyafna at any time. We may suspend or close an account that breaks these Terms, creates risk for guests or Hosts, or is required to be closed by law. Obligations that by their nature should survive — such as payment, refunds and these legal terms — continue after an account closes.
13. Changes to these Terms
We may update these Terms as Dyafna grows or the law changes. We’ll post the updated version here with a new “last updated” date, and for significant changes we’ll give reasonable notice. Continuing to use the Platform after a change means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Morocco. We’d like the chance to resolve any problem first — please contact us at salaam@dyafna.ma. Disputes that can’t be resolved are subject to the competent courts of Marrakech, Morocco. If you are a consumer in the EU/EEA or UK, you keep the protection of the mandatory consumer-law rules of your country of residence.
